ampnbspA few months ago, I notedampnbspthat Connecticuts Department of Labor has had a long-standing but, until recently, little-used work-share programampnbspunder the title of the Shared Work program. ampnbsp The Connecticut DOL describes it as: a voluntary program providing an alternative to layoffs forampnbspemployers faced with a temporary decline in business. Rather than laying off a percentage of the work force to cut costs, an employer may reduce the hours and wages of all or a particular groupampnbspof employees. The employees whose hours and wages are reduced can receive partial unemployment insurance benefits to supplement their lost wages. The J1 visa Work and Travel Program along with the F1 visa for students is possibly responsible for bringing more foreigners to the US to live, work and study than any other US visa due to their lack of fed quotas like the H1B visa. Court: DOL Must Count Out-of-State Workers to Determine if Employer Has Requisite 75 or More Employees Under Connecticut's FMLA

In a decision sure to send chills to employers with small branch offices in Connecticut, a Superior Court judge recently ruled that an employer's out-of-state employees must be counted in figuring out if an employer is subject to the state's FMLA rules.

Employers with 75 or more employees nationwide that have just one employee in Connecticut, may now be subject to Connecticut's FMLA rules for that Connecticut employee. 

This has huge implications for employers with small branch offices in Connecticut that, in the past, were not viewed as being covered under the state FMLA. It also has implications for employers based in Connecticut with less than 75 employees here but that have out-of-state workers. ...
