Petitioner fined Rs.30,000 for frivolous suit
NEW DELHI - Slapping a fine of Rs.30,000 on a petitioner for a frivolous suit, the Delhi High Court Thursday said such litigation clogs the wheels of justice. Justice V.B. D.C. Circuit Upholds OSHA Rule Permitting Employee-by-Employee Violations.
Denying the petition for review of a final rule, the U.S. Court of Appeals for the District of Columbia Circuit has held that the Secretary of Labor had authority to issue amended rules under the Occupational Safety and Health Act (“OSH Act”) to clarify that an employer’s failure to provide respirators or workplace training constitutes not one violation of the applicable health and safety standards, but separate violations for each employee who did not receive the respirator or training. National Ass’n of Homebuilders v. OSHA, No. 09-1053 (D.C. Cir. Apr. 16, 2010).
